Registering To Become A Medical Marijuana Patient

As a person takes their first steps toward becoming a medical marijuana patient in Colorado, they will find that they have many questions regarding the process and laws surrounding medical marijuana and how to proceed in becoming a registered patient. Once a patient has gone through the initial process of being referred by a licensed physician, they must then take the necessary steps toward becoming registered with the State of Colorado.

A first suggestion is to go to the Colorado Department of Public Health website at www.cdphe.state.co.us. Most of the necessary information is provided there and covers the process, forms and legal issues around applying for a medical marijuana card in Colorado. However, this article will briefly cover the basic steps needed to get a person started and on their way toward registering for a medical marijuana card.

First and foremost, anyone applying for a medical marijuana card in Colorado must prove their residency in the state. The state will require either a Colorado driver’s license or Colorado State ID card. The card must also be in good condition. Cards withcracks, tears or anything that makes the card illegible will not be accepted. Other items that can be used as proof of residency include current utility,phone or cable bills. If a person has recently moved to Colorado, the statewill also accept passports, out-of-state licenses or military ID’s with a copy of any of the aforementioned bills. A W-2 or paycheck stub may also be considered as proof of residency.

The next step will be to prove eligibility status for a medical marijuana application. Once a patient has been given a recommendation by a physician, it is up to the patient to provide medical records to prove the validity of their condition. The next and perhaps most important step in the process of registering to become a medical marijuana patient in Colorado is the application itself.

Before a person even gets started, it is highly recommended that they read up on all current Colorado medical marijuana laws, regulations, requirements and revisions to any of the laws.Knowing ahead of time what is required will save the patient time and headaches if for some reason something is done incorrectly or needs to be changed.

The application itself must be very clear. The state will not accept any applications that are illegible, have errors, have things crossed out or written over or have white-out on them. Paperwork sent to the state must be checked thoroughly before it is sent in to be sure all necessary information has been provided. The name, address and phone number must be clear and not abbreviated. Patients must make sure that their date and the notary’s date match and that the referring physician’s date is either the same or prior to the date on the application.

A personal check or money order made out to the CDPHE for $35 must be included in the application. However,this fee may be waived if the patient is able to provide proof that they receive SSI or food stamps. All applications must be sent via certified mail and only one application may be sent at one time.

It is important to note that all applications must be received by the state within 60 days of the date of the physician certification. Patients generally receive their medical marijuanacards in four to six months after the acceptance of the application.

For about 10 years now, medical marijuana has been legal in many states throughout the United States. Those who have a doctor's recommendation and a medical marijuana card are allowed to legally purchase medical cannabis at any of the hundreds of licensed medical marijuana centers or medical marijuana dispensaries throughout the legal states.

Of course, it's not just a free for all in these legal marijuana states. There are plenty of laws governing marijuana doctors and how patients can access and use this medicine. If you want to become a medical marijuana patient, you need to understand and obey these laws so you can legally access your treatment.

Bona Fide Physician-Patient Relationship

Before a recommendation can be handed out, the first thing that is important to know is that state laws dictate patients and physicians have a bona fide relationship. What exactly constitutes a bona fide relationship?

This means patients must get a full physical exam from the physician, and that marijuana doctors should look at the patient's medical history carefully. Additionally, patients need to see the physician annually for follow up care and treatment to ensure they're still a candidate for medical marijuana use.

Some states have a Waiting Period

For example, in Colorado, just because you visit one of the Colorado marijuana doctors' and get a recommendation doesn't mean you can immediately go out and purchase pot from a marijuana dispensary. New laws state that there is a 35 day waiting period for all applicants. If your application hasn't been processed within 35 days of submittal, you're automatically approved on a temporary basis to purchase medical cannabis until the state processes to your application.

But there is a catch. Despite the 35 day waiting period, patients do have the right to start possessing marijuana immediately if they have a doctor's recommendation. The catch is they can't legally purchase it from a medical dispensary within 35 days.

Laws for Using Medical Marijuana

Once you get your medical marijuana card, there are laws you have to follow for using your pot and each state varies. For example these are some of the Colorado medical marijuana laws:

  • You cannot use medical marijuana in a way that endangers the health or well-being of another person
  • You may not use medical marijuana in plain view or in a public place
  • You cannot undertake any task while under the influence of medical marijuana
  • You cannot possess medical marijuana on school grounds or in a school bus
  • You cannot use marijuana while in a correctional facility, subject to a sentence to incarceration, or in a vehicle, aircraft, or motorboat
  • You cannot possess marijuana without a legitimate physician's recommendation
